1. INFORMATION COLLECTED
Personally identifiable information (“PII”) is data that identifies a specific individual, such as name, address, telephone number, email address, and birth date. Site visitors may explore many areas of the Site without disclosing any PII to LucidMedia. The Site only collects PII if a user voluntarily provides that information. For example, if a Site visitor submits a query to LucidMedia through the Site’s “Contact Us,” function, LucidMedia may collect certain PII (such as the Site visitor’s name and email address) in order to respond.
LucidMedia does not direct the Site to, nor does LucidMedia knowingly collect any PII from, any person under the age of thirteen.
LucidMedia’s web servers automatically collect non-personally identifiable information (“NPII”)about Site visitors such as demographic information (such as age, gender, city or state), and “click stream data.” Click stream data includes information such as a Site visitor’s IP address, web pages viewed as well as date and time, and browser and platform type. These automated server functions do not collect this information in a manner intended to identify a Site visitor’s individual use of the Site, nor does LucidMedia use this information for any such purpose. LucidMedia collects this anonymous information in order to maintain a high quality site and evaluate how Site visitors use and navigate the Site on an aggregate basis.
LucidMedia uses a common Internet technology called “cookies” to collect NPII about Site visitors. A cookie is a small text file written to an Internet user’s browser that contains unique information about the Internet user. Cookies permit the Site to recall information from a Site visitor’s previous visits and customize the Site for the visitor’s future use. Cookies do not collect or transmit PII (such as a Site visitor’s name and address). LucidMedia does not use the information collected from cookies together with any PII it has collected from Site visitors.
2. HOW INFORMATION IS USED
LucidMedia only uses PII to respond to specific inquiries from Site visitors. LucidMedia will not disclose PII to any third party unless: (a) it is necessary in order to provide the Site visitor with a particular service or product the Site visitor requested; (b) it is required of LucidMedia in order to comply with a legal process in any applicable jurisdiction (e.g., court order, subpoena, search warrant, law enforcement request); or (c) LucidMedia determines, in its sole discretion, that disclosure is necessary to protect the rights, property, and safety of LucidMedia, its subsidiaries, affiliates, clients, or other parties under contract with LucidMedia, or others. 1. LUCIDMEDIA’S SERVICES
Using its patented ClickSense technology, LucidMedia provides businesses engaged in Internet advertising – advertisers, publishers, and ad exchanges – with a high value contextual advertising network. When ad space on a website is sold, LucidMedia, as an agent for its clients, fulfills the transaction by delivering the ad to the Internet user who visits that site. Generally, an Internet user’s computer comes into contact with LucidMedia’s search technology when a user visits a website, or views an ad, powered by ClickSense®.
2. INFORMATION COLLECTED
The ClickSense® technology identifies the interests of Internet users by assessing on-line activities. LucidMedia does not learn the identities of Internet users when collecting information about their interests. LucidMedia does, however, collect and use non-personally identifiable information (“NPII”) and other anonymous data to understand and analyze consumers’ Internet experiences. This anonymous data may include:
-- Visitor data relating to referring domains;
-- System settings (such as type of browser, operating system, screen resolutions, plug-ins, language settings, etc.);
-- Cookie preferences;
-- Web search terms;
-- JavaScript enablement;
-- Amount of time spent at certain Web sites;
-- Number of pages reviewed;
-- Response to advertisements; and
-- ZIP code or postal code.
Cookies: LucidMedia uses “cookies,” small text files stored a user's browser, to anonymously identify repeat visitors to a site. Cookies are used primarily to limit repetitiveness of ads and to improve the relevancy of ads displayed. LucidMedia does not use cookies to identify, monitor, or track any Personally Identifiable Information (“PII”).
Web beacons: LucidMedia uses electronic image requests (called a “web beacon” request or “single-pixel gif”) that allow it to count webpage views and access cookies. The web beacons used in connection with LucidMedia’s ad network do not collect, gather, monitor or share any PII about Internet users. Rather, web beacons are used to compile aggregate information about web site usage.
3. HOW INFORMATION IS USED
LucidMedia shares collected NPII only with its clients, and only within the context of LucidMedia’s selection of ad-content and in LucidMedia’s analysis of ad-effectiveness. When LucidMedia provides information to a client concerning the effectiveness of a specific ad campaign, LucidMedia may present the anonymous data on an individual or aggregate basis.
Based on the websites Internet users are visiting and the search terms they are using, LucidMedia may use the information it gathers to provide Internet users with warnings and alerts about certain websites and to provide information about goods and services that may interest them.
LucidMedia does not control the data collection policies of any of its clients. Internet users choosing to access websites of LucidMedia’s clients or other third-party websites should carefully review their individual privacy policies and contact them directly with any questions about their information practices.

Each party shall include conspicuously on its Site(s), a privacy policy that describes how such party collects, uses, stores and discloses users’ personal data if any is collected, including e-mail addresses, and instructs users how to opt-out of such practices. Supplier’s privacy policy shall clearly disclose: (a) the placement and use of third party cookies and the collection and use of data from user’s activities on Supplier’s website and (b) cookie management (as defined below) including a conspicuous link to the network advertising initiative website at www.networkadvertising.org.
